Distance Contract
This agreement is made between SIA "Fashion Clothing", registration number 40103277839, with its registered address at Rīga, Brīvības iela 155 k-3, LV-1012 (hereinafter referred to as "http://www.mansdrebjuskapis.lv" or "Seller"), and a natural or legal person (hereinafter referred to as "Buyer"), who purchases the offered products (hereinafter referred to as "Goods") or uses other services provided by the Seller (hereinafter referred to as "Service") on the website http://www.mansdrebjuskapis.lv (hereinafter referred to as "Website").
General Terms
1.1. http://www.mansdrebjuskapis.lv is the owner of the Website and all associated rights, offering and selling Goods and providing Services to the Buyer within the framework of its business activities under this Agreement (hereinafter referred to as "Agreement").
1.2. http://www.mansdrebjuskapis.lv provides information on the Website about Goods and Services, sells Goods, and offers Services according to the terms outlined below, as well as provides customer support. By accessing or using the Website, the Buyer confirms that they have read, understood, and agree to comply with the terms of the Agreement without any limitations or conditions.
1.3. If the Buyer purchases Goods offered on the Website via online transactions, such an agreement is considered a Distance Contract and is subject to legal regulations governing Distance Contracts, including but not limited to the European Parliament and Council Directive 97/7/EC on the protection of consumers in respect of Distance Contracts, the Consumer Rights Protection Law of the Republic of Latvia, and the Cabinet of Ministers regulations on Distance Contracts.
1.4. The Buyer is a legally capable individual who has registered and placed an order on the Website. Minors between 14 and 18 years old may use http://www.mansdrebjuskapis.lv services only with parental or guardian consent unless they have independent income.
1.5. The Agreement is considered concluded when the Buyer confirms the order by adding items to the shopping cart and clicking "pay for the purchase." The Buyer is obliged to pay for the Goods within the timeframes specified in the Agreement.
1.6. http://www.mansdrebjuskapis.lv reserves the right to unilaterally amend or supplement the Agreement. The terms of the Agreement applicable to the Buyer are those in effect at the time of placing the order.
1.7. If the Buyer attempts to harm the operation, stability, or security of http://www.mansdrebjuskapis.lv or otherwise violates the Agreement, the Seller has the right to cancel the Buyer’s registration or restrict access to the Website.
Subject of the Agreement
2.1. http://www.mansdrebjuskapis.lv undertakes to sell and deliver or make available for collection the Goods ordered by the Buyer in accordance with the terms of the Agreement.
2.2. The Buyer independently selects the Goods and places orders, making payments in accordance with Sections 4 and 6 of the Agreement, considering the following:
- The Buyer reviews product descriptions, prices, and their suitability.
- The Buyer selects the desired Goods and completes the order and payment process according to the Agreement and payment options available on the Website.
2.3. http://www.mansdrebjuskapis.lv delivers the ordered and paid Goods using courier services to a specific parcel locker or the address provided by the Buyer in compliance with the Agreement.
Registration
3.1. Shopping at http://www.mansdrebjuskapis.lv is available for both registered and unregistered Buyers.
3.2. To register, the Buyer must provide their name, surname, email address, and password in the "My Account" section.
3.3. To make a purchase, the Buyer must provide their full name, delivery address, phone number, and email.
3.4. The Buyer must keep their password confidential and is responsible for any actions taken under their account. If third parties gain access to the Buyer’s credentials, the Buyer must immediately change their password.
3.5. By providing their data, the Buyer grants http://www.mansdrebjuskapis.lv the right to collect, store, and process the provided information for order fulfillment and customer support purposes.
3.6. Personal data processing complies with the European Parliament and Council Directive 95/46/EC and relevant Latvian regulations.
3.7. The Buyer's personal data is stored only as long as necessary for data processing purposes.
3.8. http://www.mansdrebjuskapis.lv does not disclose personal data to third parties, except for partners providing order fulfillment services.
Ordering Goods
4.1. To place an order, the Buyer selects the desired Goods and adds them to the shopping cart.
4.2. The Buyer follows these steps to complete the order:
- Adds selected Goods to the cart.
- Reviews the cart and order details.
- Proceeds to checkout and enters payment details.
- Confirms the order and payment.
- Receives an order confirmation via email.
4.3. The Buyer must provide accurate data for order fulfillment. Incorrect data may result in order cancellation.
4.4. The Seller is not responsible for order fulfillment issues caused by incorrect Buyer-provided data.
4.5. The Seller may refuse to fulfill an order if the Buyer’s data is incorrect or their actions violate general principles.
Prices and Payment
5.1. Prices include applicable taxes. Delivery charges are stated separately.
5.2. Prices are displayed in EUR. Payments are processed in EUR through Maksekeskus AS.
5.3. Payment methods include:
- Bank links (Swedbank, SEB, Luminor, Citadele, Revolut, Apple Pay, Google Pay).
5.4. Payments are processed through a secure payment gateway provided by Maksekeskus AS.
5.5. The applicable price is the one in effect at the time of order confirmation.
5.6. Payment is considered completed when the full amount is received in the Seller’s account.
Delivery of Goods
6.1. The Buyer must provide an accurate delivery address. If selecting store pickup, the order must be collected within 7 calendar days, or it will be canceled.
6.2. The Buyer must collect the Goods from the courier or parcel locker.
6.3. Delivery fees via Omniva parcel machine:
- Latvia: 2.45 EUR
- Lithuania: 4.55 EUR
- Estonia: 5.65 EUR
Free delivery via parcel machine is available for orders over 65 EUR in Latvia and 95 EUR in Lithuania and Estonia.
Delivery fees via Omniva courier:
- Latvia: 6.45 EUR
- Lithuania: 7.80 EUR
- Estonia: 7.80 EUR
Free delivery via courier is available for orders over 110 EUR in Latvia and 120 EUR in Lithuania and Estonia.
6.4. http://www.mansdrebjuskapis.lv aims to deliver orders as quickly as possible.
6.5. If the Buyer is unavailable at the provided address, the order may be handed to another adult at the location.
6.6. If delivery is not possible due to the Buyer’s fault (e.g., incorrect address), the order is canceled, and only the product cost is refunded (delivery fees are non-refundable).
6.7. If using courier delivery, the Buyer must confirm receipt with a signature.
Product Quality
7.2. http://www.mansdrebjuskapis.lv provides a guarantee for the products as specified by applicable law.
7.3. In cases where the Goods do not conform to the Agreement, the Buyer is entitled to request one of the following:
- Correction of the non-conformity;
- Exchange of the product for one that complies with the Agreement;
- Refund of the purchase price upon return of the product.
7.4. Initially, the Buyer may request that the Seller correct the non-conformity or exchange the product without additional cost, unless this is not possible or is disproportionate.
7.5. If the non-conformity cannot be corrected or the product exchanged without additional cost, the Buyer may request the cancellation of the contract and a refund. Returns and exchanges apply only to new, unused Goods in their original packaging with all original labels intact and in full set.
7.6. For minor non-conformities that do not affect the core functionality or usage of the product, the Buyer may not be entitled to contract cancellation and refund.
7.7. If the Buyer believes the product does not meet quality standards, please contact us at mdskapis@gmail.com to discuss possible solutions. Complaints regarding product quality will be addressed within 7 working days.
7.8. If the Seller accepts the Buyer's claim as justified, all necessary actions will be taken promptly to resolve the issue.
Right of Withdrawal and Returns
8.1. If the Buyer is a consumer (a natural person purchasing for purposes other than business or professional activity), the Buyer may exercise the right of withdrawal without providing any reason. In accordance with the Cabinet of Ministers Regulation No. 255 "Rules on Distance Contracts," the Buyer has the right to withdraw from the purchase or exchange the product within 14 calendar days of receipt.
8.2. To exercise the right of withdrawal or exchange, the Buyer must complete the return form at https://atgriesana.omniva.lv/ and provide the required personal and product details. For exchanges, please contact us at mdskapis@gmail.com.
8.3. The right of withdrawal is considered valid if the Buyer submits the withdrawal request before the 14-day period expires. In case of disputes, the Buyer must provide documented proof of the withdrawal period.
8.4. After registering the withdrawal, the Buyer must return the product to the Seller's address: Brīvības 155/3, Rīga, LV-1012, within 14 days from receipt. The deadline is met if the product is sent or delivered back before the 14-day period expires.
8.5. Refunds will be processed within 5 working days of receiving the returned product.
8.6. If the Buyer exercises the right of withdrawal in time, the Agreement is terminated and the Seller will refund the payment using the account details provided in the return form or by the original payment method if no account number is given.
8.7. If the Buyer clearly requested a different delivery method at the time of purchase that is not the standard cheapest option offered by the Seller, the Seller is not obligated to refund any additional delivery charges.
8.8. The direct return costs are borne by the Buyer. If the product cannot be returned via postal service or parcel locker due to its characteristics, the Buyer covers all associated costs.
8.9. The right of withdrawal applies under the following conditions:
- The returned product(s) must be in the original packaging;
- The product must not be damaged;
- The product must not be used and retain its original commercial appearance (original labels attached, undamaged protective film, etc.);
- The product must be returned in the same condition and completeness as received.
8.10. The Seller reserves the right to refuse a return if the deadlines are not met.
8.11. The Buyer is responsible for maintaining the product's quality and safety during the withdrawal period. Any reduction in value due to improper use may affect the refund amount. The product must be returned with all accompanying documents and accessories.

Liability and Dispute Resolution
9.1. Both parties are liable for any losses caused by their negligence or willful misconduct, provided the loss is proven by the aggrieved party.
9.2. In case of loss, the liable party shall compensate for the direct damages.
9.3. Any disputes arising from this Agreement shall be resolved through mutual negotiation. If negotiations fail, disputes will be resolved in accordance with the applicable Latvian laws.
9.4. If the Seller considers the Buyer’s claim unfounded, and the Buyer does not agree, or is dissatisfied with the proposed resolution, the Buyer may use alternative dispute resolution options available under the Consumer Rights Protection Law.
9.5. Consumers (natural persons purchasing for non-business purposes) have the right to enforce and protect their legal consumer rights as provided by law.
9.6. The Seller is not responsible for minor discrepancies in product appearance due to device settings, lighting, or other external conditions.
9.7. The Seller is not liable for delays or non-performance caused by circumstances beyond reasonable control, including strikes, government orders, armed conflicts, national emergencies, terrorism, environmental anomalies, third-party failures, internet disruptions, or technical issues.
Other Terms
10.1. The relationship between the Buyer and Seller is governed by this Agreement and the laws of the Republic of Latvia.
10.2. In matters not covered by this Agreement, the parties will adhere to the applicable laws of the Republic of Latvia.
10.3. The invalidity of any provision of this Agreement does not affect the validity of the remaining provisions.
10.4. By entering into this Agreement, the Buyer confirms that all terms are clear and fully accepted.
